Q: When a balcony (or other EEE) has concealed wood framing, does a purely visual inspection comply with SB-721 or SB-326?
A: NO!!!
This shouldn't be a controversial topic, yet here we are.
SB-721 and SB-326 both require that the qualified inspector visually inspect the load-bearing components (in other words, the wood framing and sheathing) through the least invasive means necessary. Unfortunately, many inspection firms in the industry falsely interpret the laws as only requiring a purely visual inspection.
That is a DEADLY misunderstanding!

When our team was evaluating the conditions of the original balcony from the apartment building in Berkeley that failed, killing and injury several young people, the message could not have been more clear:

Here's the issue: The outside of the balcony looked fine, with no visible evidence distress, but according to the inspector on the scene the framing inside the assembly more closely resembled pulled pork!
The authors of both SB-721 and SB-326 were well informed on this situation, but unfortunately the wording of both pieces of legislation have led to unfortunate misinterpretation by inspection professionals, property owners/managers, and legal counsel alike.
Prior to the establishment of either SB-721 or SB-326, the Balcony Assurance process was created as a direct response to our findings in the investigation of the Berkeley collapse. Working closely with our client partners over nearly a decade, the process has become the standard for ensuring the safety of EEEs.
Reminder: There are No 'One Size Fits All' Solutions
Consideration also needs to be given for the design and construction of each type of assembly, and for the possibility of encountering things like fire-resistive construction, fire sprinklers, electrical conduits, or other complications. And don't even get us started on Juliet balconies and railings!
