According to the experts advising the state legislators that ultimately created the California inspection laws, SB-721 and SB-326, an Exterior Elevated Element (or "EEE") must meet the following criteria:
This includes not only balconies, but also decks, elevated walkways, stairs and landings. It also includes so-called "Juliet" balconies or railings. It does not however include roof decks.
In both San Francisco's Housing Code Sec. 604 and Berkeley's BMC 19.40.040, roof decks are not exempted from inspection requirements. Additionally, San Francisco does not exempt assemblies that are steel and do not rely on wood at all.
